Cybercrimes in Turkish Penal Code


Cybercrime is addressed in the Turkish Penal Code (TPC) under the title "Crimes Committed through the Use of Information Technologies and Communication Tools." The TPC defines several types of cybercrime, including:

  1. Unauthorized access to a computer system: This includes breaking into a computer system without permission or using someone else's computer system without permission.

  2. Unauthorized interference with a computer system: This includes altering or destroying data in a computer system without permission, or disrupting the normal operation of a computer system.

  3. Unauthorized data processing: This includes collecting, storing, or sharing personal data without the consent of the individuals concerned.

  4. Unauthorized use of a computer system: This includes using a computer system for illegal activities, such as hacking or distributing malware.

  5. Unauthorized distribution of a computer program: This includes distributing malware or other malicious software without the consent of the computer system owner.

  6. Unauthorized interception of a communication: This includes intercepting or listening to someone else's communications without their consent.

  7. Unauthorized publication of private data: This includes publishing or sharing private information about someone without their consent.

  8. Unauthorized use of another person’s identity: This includes impersonating someone else online or using someone else's personal information without their consent.

All of these cybercrimes are punishable by imprisonment and fines. The TPC also has provisions for the extradition of individuals who commit cybercrimes in other countries.
